Fair wear and tear is NOT claimable
Under the Residential Tenancies Act 1987 (WA), a landlord cannot claim for fair wear and tear — the natural deterioration that happens through ordinary, reasonable use over time.
Not claimable (fair wear and tear):
- Carpet worn thin in high-traffic areas
- Minor scuffs and marks on walls
- Paint faded by sunlight
- Loose hinges or taps from normal use
Claimable (damage / neglect):
- Burns, large stains, or tears in carpet
- Holes punched in walls or doors
- Broken fixtures from misuse
- Deliberate or negligent damage
