Fair wear and tear is NOT claimable

Under the Residential Tenancies Act 1987 (WA), a landlord cannot claim for fair wear and tear — the natural deterioration that happens through ordinary, reasonable use over time.

Not claimable (fair wear and tear):
  • Carpet worn thin in high-traffic areas
  • Minor scuffs and marks on walls
  • Paint faded by sunlight
  • Loose hinges or taps from normal use
Claimable (damage / neglect):
  • Burns, large stains, or tears in carpet
  • Holes punched in walls or doors
  • Broken fixtures from misuse
  • Deliberate or negligent damage
